looks and functions the way it is supposed to are owned by the
author of those works.
Elements including (but not
limited to); design, graphic design, images, photos, icons, html
coding, scripts, SEO, etc. are all protected by US and International
Copyright laws.
While
Search Engines make it very simple to travel the web and find
copy (text) and images (pictures and graphics) that are easily
downloaded and saved or potentially used for personal or
commercial purposes - it is unlawful (illegal) to do so unless
those items are considered Public Domain. All other elements are
protected by Copyright and therefore written permission must be
obtained from the author.
I, David
Williams, will not knowingly use known copyrighted material
unless you provide me with a signed Authorization to Reproduce
form from the author of said works that holds both you and your
agent (developer) free from harm.
Likewise, by choosing me, David Williams, as your web developer you
accept the same terms and limitations according to US and
International Copyright Law regarding works created and
limitations surrounding Fair
Use.
Further, you understand that all works and intellectual
properties created by David A. Williams are protected by US and
International Copyright Laws and the Digital Millennium
Copyright Act of 1998.
Below
are links to help you better understand your limitations of
usage and legal obligations to David A. Williams as the owner of
said copyrighted works.
Simply
put - It is forbidden to use David A. Williams' work(s) (or any
other designer - developers works) and/or
intellectual properties without written consent from the author.
In the unlikely event that you (as the client) and David
Williams (as the developer and SEO) should come to a point of
separation and/or termination of services David Williams (the
developer and SEO) retains the rights of the intellectual
properties, design, SEO and coding elements, etc. unless
otherwise agreed and/or released in writing and signed by both
parties.
Please Note: It is
imperative for you to understand that you make this same agreement
with any developer, designer, graphic designer, etc. that you hire whether it is verbalized
or not. David Williams simply states it up front so there is no
room for misunderstandings.
